Memorandum of Agreement
between
Lane Community College
and
Lane Community College Employees Federation
This agreement is limited to the Process Redesign Project and the parties, hereafter know as the Federation and the College, agree to the following:
A Satisfactory Employee Security Agreement* will include:
1. A realization that job changes are potentially imminent
The Federation acknowledges that the College has engaged in a redesign process and is aware of potential changes to wages, hours and working conditions that may occur as a result of the process.
2. That no negative (-) financial impact to employees impacted by the process redesign efforts during the first year of implementation
The first year begins when the implementation recommendations change a work assignment or assign differing core duties to an employee. The first year is twelve months in length.
3. All issues must be resolved prior to changes in work assignment or duties
No changes in wages, hours or working conditions can occur without first bargaining to conclusion with the Federation. If the parties have fully explored all of the options regarding an issue and need to engage in a third party process for resolution, the College may proceed with implementation of changes in wages, hours or working conditions with the understanding that any benefit to the employee with be retroactive to the date of change.
4. A commitment to problem resolution
A commitment by the parties to resolve issues that come before them in a timely manner in order to ensure the success of the redesign efforts.
5. A commitment to place the issues of the Federation and the College at a high priority
A good faith effort by the parties is required to ensure resolution priority and subsequent success of the redesign efforts. The commitment to resolution foes not preclude or expand the state or federal laws governing dispute resolution.
6. Use of the Dispute Resolution Process
There is an agreement between the parties to use and implement the Dispute Resolution Process when needed regarding contract issues and that the Dispute Resolution Process will be used to resolve any additional issues identified now or in the future.
7. Communication Between the Parties
The Federation and the College bargaining agents shall be informed in writing, of all committee recommendations. The federation will timely advise the College, in writing, of its desire to negotiate the impact of any recommendations. Subject to paragraph number three (#3) above, bargaining obligations shall be fulfilled prior to the implementation of any such recommendations.
It is an understanding of the parties that is memorandum of agreement will expire when the contract between the parties expires per collective bargaining law. The issues listed above fit under the purview of the 'status quo' and shall be maintained until a subsequent contract is bargained and ratified at which time these issues will be re-addressed.
